These terms govern the use of Mapira, the collaborative map app provided by Faber Gómez Gómez, operating as Phanteus (Pasto, Nariño, Colombia; phanteus.group@gmail.com). By creating an account or posting on Mapira you accept these terms, the Privacy policy and the Community guidelines. The Spanish version is the reference text; if the two differ, the Spanish version prevails.
1. What Mapira is
Mapira is a platform where people and communities post, confirm and look up information tied to places: traffic, road closures, roadworks, events, useful places and more, on a public map or in private groups.
Posts are reports from other users, not official information or information verified by Phanteus. They may be incomplete, outdated or wrong. Use them with judgment and double-check when it matters.
Mapira is not an emergency service. If you or someone else is in danger, call 123 in Colombia or your country’s emergency number. Do not use the app while driving.
2. Your account
- You can browse the map without an account. You need one to post, confirm, report or use groups.
- You must be at least 13 years old (or the minimum age in your country). If you are a minor, you need the authorization of your parents or guardians.
- Your account details must be truthful and the account is personal. You are responsible for what is done with it and for keeping your password safe.
- Your display name and username must not impersonate anyone or be offensive.
3. Your content
- What you post remains yours. You grant us a free, non-exclusive, worldwide license to host it, display it, adapt it to the app’s format and distribute it within Mapira (including alerts to the members of your groups), while it is published and during the retention periods in the Privacy policy.
- You are responsible for what you post: it must be true to the best of your knowledge, follow the Community guidelines and not infringe third-party rights or the law.
- You can retract your posts at any time from their details.
4. Acceptable use
In addition to following the Community guidelines, you agree not to:
- use Mapira for illegal activities or to facilitate crimes;
- collect other users’ data, scrape content in bulk or by automated means, or create fake or bulk accounts;
- manipulate confirmations or reports, or coordinate campaigns to distort information;
- interfere with the operation or security of the service, or try to access data that is not yours.
5. Groups
- Group owners and admins manage its members, roles and invitations, and can remove content from the group.
- What is posted in a private group is only visible to its members.
- Whoever creates a group is responsible for how it is used. The Community guidelines also apply within groups.
- If the owner deletes their account, the group passes to the highest-ranking, longest-standing member; if no one is left, it is deleted.
6. Moderation
We may review, hide or remove content and restrict accounts that break these terms or the guidelines. Community reports are signals that we review: no account is banned automatically because of the number of reports. Measures are gradual (warning, temporary restrictions, suspension and, in serious cases, a ban) and you can appeal them by writing to phanteus.group@gmail.com.
7. Advertising and third-party services
Mapira may show Google AdMob ads and uses third-party services such as the OpenFreeMap base map (data © OpenStreetMap contributors) and place search providers. Their use is also governed by their own terms. We are not responsible for the content of ads or the sites they link to.
8. Availability and changes to the service
Mapira is under active development: we may add, change or remove features, and the service may be interrupted for maintenance or for reasons beyond our control. We offer it free of charge and “as is”, without guaranteeing that it will always be available or error-free.
9. Liability
To the extent permitted by law, Phanteus is not liable for damages arising from decisions made based on other users’ posts, from content posted by third parties or from service interruptions. Nothing in these terms limits the rights granted to you by applicable consumer protection laws, such as Colombian Law 1480 of 2011.
10. Termination
You can stop using Mapira and delete your account whenever you want from the app (how to do it). We may suspend or close accounts that seriously or repeatedly break these terms, telling you why unless the law or other people’s safety prevents it.
11. Governing law
These terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Colombia, without prejudice to the rights granted to you as a consumer by the law of your country of residence.
12. Changes to the terms
If we change these terms, we will publish the new version here with its date. If the change is significant, we will let you know in the app and ask you to accept the new version before you post again.
